FullBeauty Brands Lawsuit Seeks

The Toppe Firm is investigating a class action lawsuit against FullBeauty brands (Catherine’s, Avenue, King Size Direct, Woman Within) related to their email marketing practices. Our investigation reveals that FullBeauty frequently send emails with false or misleading information in the subject lines, in violation of Maryland law. The lawsuit will allege that FullBeauty repeatedly represented to consumers that a sale was in its “FINAL HOURS,” or that it was the “Last day” to obtain the sale. The lawsuit will allege that these representations were false because, in many instances, the sale was not in its “final hours,” and it was not the consumer’s “last day” to obtain the sale. The lawsuit will allege that FullBeauty “always planned the sale to continue” beyond the represented end date, and the misrepresentations were intended to create a false sense of urgency in order to drive sales.

Maryland law prohibits a business from making these types of allegedly false and misleading statements in email subject lines, as these types of statements have the capacity to deceive consumers. The lawsuit will seek $500 in statutory damages per unlawful email.
