Tommy Bahama Lawsuit Seeks

The Toppe Firm has filed a class action lawsuit against Tommy Bahama related to their email marketing practices. The lawsuit, filed into the Circuit Court of Maryland for Baltimore County, alleges that Tommy Bahama repeatedly represented to consumers that they would receive a “FREE” gift, when in fact a large purchase (sometimes up to $250) was required in order to obtain the gift. The plaintiffs allege these types of emails violate state anti-spam laws.
There are specific consumer protection laws in various states that prohibit a business from making these types of allegedly false and misleading statements in email subject lines, as these types of statements have the capacity to deceive consumers. The lawsuit seeks $500 in statutory damages per unlawful email, and the plaintiff seeks to represent all individuals who have received these types of emails from Tommy Bahama.
